Terms & Conditions

 
1.  This international Photo Magazine submission is open to anyone of minimum 18 years old and from any Country.
 
2.  All information detailing how to submit your image(s) forms part of these terms and conditions. It is a condition of entry that all terms and conditions are adhered to. Submission of an entry will be taken to mean acceptance of these terms and conditions. 
 
3.  The decisions to select or reject images for publication are final. No correspondence will be entered into regarding such decisions.

5.  All entries received after a closing date for submissions will be kept for the following edition of the magazine.
 
6.  Entrants under the age of 18 must obtain the consent of a parent or guardian prior to submitting any images. 
 
7.  All images submitted must be the work of the individual submitting them and preferably not have been published elsewhere else before. We are very flexible on the “already published” rule if the image is of top quality and interest. 
 
8.  All images entered can be of any photographic genre (Landscape, Fashion, Beauty, Portrait, Street Life, Macro, Sports, Nature…). However, we will not accept full nudity images.  
 
9.  It is the responsibility of each entrant to ensure that any images they submit have been taken with the consent of anyone who is identifiable, or owns any property, in that image or the consent of their parent/guardian if they are under 18 and that they have been advised of the purpose of the submission and that their photograph may be published by the “Xclusive Photo Mag”. “Xclusive Photo Mag” has no legal responsibility over the images submitted for publication.
 
10.  Entrants must ensure that the photographs they are submitting are their own work, that they own the copyright for them and that they do not infringe the copyright or other rights of any third party or any laws.
 
11.  Entrants will retain copyright and moral rights in their submitted images however, by entering, all entrants: 
(a) grant “Xclusive Photo Mag” non-exclusive rights to use the images on the cover or inside pages of any edition of its magazine.
(b) grant “Xclusive Photo Mag” non-exclusive rights to use the images to promote the magazine or a eventual competition; 
(c) agree that the uses referred to at Clauses 11(a) and 11(b) above may include publishing, displaying or otherwise reproducing the images (whether on the internet, in the “Xclusive Photo Mag” Magazine, in exhibitions or otherwise) provided such use is for the purposes of promoting the magazine or future competitions only; images might have a partial cropping to fit the available spaces and/or technical specifities of the publications; images may also have some colours and/or tonalities variations due to the conversion in CMYK for the printed publication and
(d) agree that “Xclusive Photo Mag” may contact them using the contact details they provide to discuss potential use of the images beyond promotion of the magazine or competition.  
 
12. “Xclusive Photo Mag” will endeavour to credit the photographer whenever his or her image is used and published by “Xclusive Photo Mag”.
 
13. Events may occur that render the publication itself impossible due to reasons beyond the control of “Xclusive Photo Mag” and accordingly “Xclusive Photo Mag” may at its absolute discretion vary or amend the promotion and the entrant agrees that no liability shall attach to the promoter as a result thereof.
 
14. Submitting images to be published in “Xclusive Photo Mag” is voluntary and free of charge. There will be no remuneration nor any kind of financial compensation or other advantages given to the participant photographers.
 
15. “Xclusive Photo Mag”, “Exclusive Photo Mag”, “The Xclusive Photo Mag” and “The Exclusive Photo Mag” are Trade Names owned and operated by Gaitder Ltd, registered Company # SC571748 in Scotland.
 
16. Scots law applies and the exclusive jurisdiction of the Scottish Courts shall prevail.
